Samsung is certainly not pleased with the previous court ruling which Samsung was asked to pay Apple 1 billion dollars in damages for infringing some of Apple's design patents. A few days before the iPhone 5 announcement there were some some rumors that Samsung is preparing to sue apple over some of the 4G patents which has been infringed by the iPhone 5. Samsung is claiming that the iPhone 5 has infringed on 8 of Samsung;s LTE patents and they are preparing to sue Apple and the hearing for this lawsuit will start on the 26th of September. Just as the lawsuit is about to start Samsung is most probably going to be asking the court for a preliminary injunction of the iPhone 5 and this similar move was made by Apple when suing the Galaxy Nexus over the world search feature.

On September 12, 2012, Apple announced that it will release the iPhone 5 on September 21, 2012. Based on information currently available, Samsung expects that the iPhone 5 will infringe the asserted Samsung patents-in-suit in the same way as the other accused iPhone models. Samsung plans to file a motion to amend its infringement contentions to address the iPhone 5 as soon as it has had a reasonable opportunity to analyze the device. Because Samsung believes the accused functionality of the iPhone 5 will be similar to the accused functionality of other accused Apple products, Samsung does not believe that amendment of its infringement contentions should affect the case schedule."
